Terms of Service for FarmEquipFixSvc

Welcome to FarmEquipFixSvc. These Terms of Service ("Terms") govern your use of our website and farm equipment repair services. Please read these Terms carefully before using our services. By accessing or using our website, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using our website, requesting quotes, scheduling services, or engaging our repair services, you accept and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use our services.
2. Services Provided
FarmEquipFixSvc provides professional farm equipment repair and maintenance services, including but not limited to:
- Tractor repair and maintenance
- Combine harvester service
- Seeding equipment calibration and repair
- Hydraulic system repairs
- Engine diagnostics and repair
- Transmission services
- Welding and structural repairs
- Preventive maintenance programs
3. Eligibility
You must be at least 18 years old and capable of forming a binding contract to use our services. By using our services, you represent and warrant that you meet these eligibility requirements.
4. Equipment Drop-off and Pickup
4.1 Drop-off Requirements: All equipment must be safely transported to our facility. We are not responsible for damage occurring during customer transport to our location.
4.2 Pickup Scheduling: Equipment pickup will be scheduled at mutually agreed times. Delays in pickup may result in storage fees at our standard rates.
4.3 Equipment Condition: You represent that all equipment provided for service is legally owned or that you have proper authorization to have the equipment serviced.
5. Estimates and Quotes
5.1 Written Estimates: All estimates are provided in writing and are valid for 30 days from the date of issuance. Estimates are based on information available at the time and may be adjusted upon further inspection.
5.2 Authorization Required: No work will begin without your written authorization. Additional work discovered during service will require separate authorization and approval.
5.3 Price Changes: Prices are subject to change based on parts availability, additional issues discovered, or changes in scope of work.
6. Payment Terms
6.1 Payment Methods: We accept cash, major credit cards, and business checks. Payment is due upon completion of services unless other arrangements are made in writing.
6.2 Late Payments: Accounts overdue by more than 30 days will incur interest at 1.5% per month (18% APR) or the maximum rate allowed by law.
6.3 Returned Checks: A fee of $35 will be charged for any returned check or failed electronic payment.
6.4 Liens: We retain a mechanic's lien on all equipment until full payment is received, as provided by New Mexico and Texas law.
7. Warranty and Guarantees
7.1 Workmanship Warranty: All labor is guaranteed for 90 days from the date of completion. This warranty covers defects in workmanship under normal use.
7.2 Parts Warranty: Parts are covered by the manufacturer's warranty. We will assist in processing warranty claims but are not responsible for manufacturer warranty denials.
7.3 Warranty Limitations: Warranty does not cover damage caused by improper use, lack of maintenance, accidents, or modifications made after service completion.
7.4 Warranty Claims: All warranty claims must be reported in writing within the warranty period. Equipment may need to be returned to our facility for inspection.
8. Limitation of Liability
8.1 Maximum Liability: Our total liability for any claim arising out of or relating to our services shall not exceed the amount paid for the specific service that gave rise to the claim.
8.2 Excluded Damages: In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, crops, or use of equipment.
8.3 Equipment Value: You agree to inform us in writing of any equipment value exceeding $5,000. Additional insurance may be required for high-value equipment, and we recommend adequate coverage for your machinery.
9. Customer Responsibilities
9.1 Equipment Preparation: All equipment must be clean and free of excessive dirt, debris, or hazardous materials before service.
9.2 Safety: You are responsible for ensuring equipment is safe to transport and service. This includes securing loose parts and draining hazardous fluids when required.
9.3 Information Accuracy: You must provide accurate information about equipment issues, maintenance history, and any modifications made to the equipment.
9.4 Timely Pickup: Equipment must be picked up within 14 days of completion notice to avoid storage fees.
10. Cancellations and Changes
10.1 Service Cancellations: Cancellations made more than 24 hours before scheduled service are free. Cancellations within 24 hours may incur a $50 service preparation fee.
10.2 Rescheduling: We will make reasonable efforts to accommodate schedule changes, subject to availability.
10.3 No-Shows: Failure to appear for scheduled appointments without notice may result in a $75 missed appointment fee. We understand that farming schedules can be unpredictable, and we will work with you to reschedule when possible.
11. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of FarmEquipFixSvc and is protected by copyright and trademark laws. You may not use any content from our website without our express written permission.
12. Indemnification
You agree to indemnify, defend, and hold harmless FarmEquipFixSvc, its owners, employees, and contractors from any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
- Your use of our services
- Your violation of these Terms
- Any claim that your equipment infringes upon the rights of any third party
- Any damage caused by your equipment to our facility or personnel
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of New Mexico, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Lea County, New Mexico.
14. Dispute Resolution
14.1 Informal Resolution: We encourage you to contact us directly to resolve any disputes informally before pursuing other remedies.
14.2 Small Claims Court: For claims under $10,000, either party may file in small claims court instead of pursuing other legal remedies.
14.3 Class Action Waiver: You agree to bring any claim against us in your individual capacity only, not as a plaintiff or class member in any class or representative action.
15. Force Majeure
We shall not be liable for any failure or delay in performance of our services due to events beyond our reasonable control, including but not limited to acts of God, natural disasters, labor disputes, government actions, or material shortages.
16. Entire Agreement
These Terms constitute the entire agreement between you and FarmEquipFixSvc regarding the use of our services and supersede all prior agreements and understandings, whether written or oral.
17. Changes to Terms
We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the updated Terms on our website. Your continued use of our services after any such changes constitutes your acceptance of the new Terms.
